Terms of Service

1. Agreement

These Terms govern your use of photoloopai.com and everything on it (the "Service"), operated by PhotoLoop ("we", "our", "us"). PhotoLoop is an independent service operated by an individual sole proprietor. By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service Does

PhotoLoop turns a still image plus a text prompt into a short AI-generated video, using third-party AI models. Output is generated by a machine and is not reviewed by a human before you see it.

Free tier

• One video per person per day.
• 5 seconds, 480p, with audio.
• No watermark.
• Results are deleted after 24 hours, download yours before then.

The free tier exists at our discretion. We may change its limits, pause it, or withdraw it at any time, including to control cost or abuse.

Paid credits

Paid generation is billed in credits, purchased in packs. The credit cost of a generation depends on the model, duration, and resolution, and is shown to you before you confirm. Credits are a prepaid balance for using the Service; they are not money, not a stored-value instrument, and cannot be transferred or cashed out. If a generation fails on our side or the provider's, the credits are returned to your balance automatically.

3. Your Account

• You must be at least 18, or old enough to form a binding contract where you live and have your guardian's permission.
• Give accurate information and keep your password to yourself. You are responsible for what happens under your account.
• One person, one account. Creating extra accounts to farm the free tier is a breach of these Terms.
• Tell us at support@photoloopai.com if you think your account has been accessed by someone else.

4. What You Upload

You keep ownership of the images and prompts you submit. By submitting them you give us the limited licence we need to run the Service: to store them, to send them to our AI provider, and to produce and deliver your video. That licence ends when the content is deleted.

You promise that you own or are licensed to use whatever you upload, and that you have the consent of any identifiable person in it. We do not use your uploads to train AI models.

5. What You Get Back

We claim no ownership of the videos you generate. As between you and us, they are yours, including for commercial use.

Two honest limits on that. First, videos are produced by a third-party model, so your rights are also subject to that provider's terms, which we do not control. Second, in many countries the copyright status of purely AI-generated output is unsettled, so we cannot promise you an enforceable copyright in it. If commercial use matters to your business, get your own legal advice.

The same prompt may produce similar results for other users. Your outputs are not exclusive to you.

6. Acceptable Use

You may not use the Service to create, upload, or distribute:

• Sexual content involving minors, or any sexualised depiction of a real person made without their consent, including intimate imagery. This is a permanent, no-warning ban and may be reported to the authorities.
• Content that impersonates a real person or organisation in order to deceive, including political disinformation and fake endorsements.
• Content that harasses, threatens, defames, or incites violence or hatred against people.
• Content that infringes someone else's copyright, trademark, privacy, or publicity rights.
• Content that is illegal where you are, or where we operate.

You also may not:

• Use bots, scripts, multiple accounts, VPN rotation, or any other trick to get around the free-tier limit, the bot check, or credit charges.
• Resell, sublicense, or wrap the Service as your own product, or use it to build a competing service.
• Attempt to break, overload, reverse-engineer, or gain unauthorised access to the Service or its providers.
• Scrape the Service or use it to build a dataset.

To report a violation, email support@photoloopai.com with the URL and what is wrong with it. We may remove content and suspend or terminate accounts that breach this section, without refund.

7. Copyright Complaints

If you believe content on the Service infringes your copyright, send a notice to support@photoloopai.com containing: your contact details; identification of the work; the URL of the offending content; a statement that you have a good-faith belief the use is unauthorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them; and your signature. We remove infringing content and terminate repeat infringers. If your content was removed in error, you may send a counter-notice to the same address.

8. Payment

Payments are processed by Creem. Prices are in US dollars and exclude any tax that applies where you live. Purchases are charged at the time of purchase. Refunds are governed by our Refund Policy, which forms part of these Terms. We may change prices for future purchases; credits you have already bought are not revalued.

9. Availability

The Service depends on third-party AI providers and can be slow, degraded, or unavailable. We do not offer an uptime guarantee, and we may change or discontinue features. If we discontinue the Service entirely, we will give registered users reasonable notice and refund unused paid credits.

10. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the output will meet your expectations, be accurate, or be free of defects. Some jurisdictions do not allow these exclusions, in which case they apply to the fullest extent permitted, and nothing here removes rights that consumer law gives you and that cannot be waived.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 50. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

12. Indemnity

You will defend and indemnify us against claims arising from your use of the Service, the content you upload or generate, or your breach of these Terms.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, or if we are required to. On termination your right to use the Service ends immediately; unused paid credits are refundable under the Refund Policy unless the termination was for a breach of the Acceptable Use section.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to conflict-of-law rules, and disputes will be brought in the courts located there. If you are a consumer in the EEA or the United Kingdom, this does not deprive you of the protection of the mandatory laws of your country of residence, or of your right to bring proceedings there.

15. Changes

We may update these Terms. We will update the Effective Date above, and for material changes we will notify registered users by email before they take effect. Continuing to use the Service after that means you accept the new Terms.
